Key Provisions of the POPI Act - Our Compliance Policy
Vital Element will take all reasonable measures to ensure that any personal information it collects and submits to third parties is protected and used only for recruitment purposes.
Job Seeker/Candidate:
Vital Element uses the following methods to collect personal information for recruitment purposes:

Job portals, social networking and media sites used by Job Seeker/Candidates.

Job Seeker/Candidates apply direct for vacancies advertised by Vital Element.

Job Seeker/Candidates contact Vital Element to request assistance with recruitment.
Storage:

All personal information collected by Vital Element will be stored inhouse (as a soft copy).

Information collected by Vital Element will not be kept for a period longer than necessary for the purpose it was originally collected for, unless consent to store the Job Seeker/Candidate’s personal information is received from the Job Seeker/Candidate.

Vital Element will store the Job Seeker/Candidate’s personal information for a period of five years providing consent is received from the Job Seeker/Candidate.

On expiry of the five years, Vital Element will contact the Job Seeker/Candidate to update their information and consent to store it for a further five years. Should Vital Element fail to obtain the consent of the Job Seeker/Candidate, their personal information will be deleted.

At any time during the five years’ storage period, the Job Seeker/Candidate may request that Vital Element updates their personal information or removes it from the data base.
All information collected by Vital Element will be treated as confidential and will not be shared without the consent of the Job Seeker/Candidate. Once consent has been received Vital Element will only share their information with the relevant parties: Vital Element employees, referees listed by the Job Seeker/Candidate, suppliers conducting the criminal and credit and qualification (background) checks and the Client that is hiring.
Vital Element will not accept any liability for any damages, losses or expenses that may be incurred resulting from information being made available on any job portal, social networking, or social media page.
Clients:
We ensure ongoing compliance with the obligations imposed on us by the POPI Act by taking appropriate technical and organizational measures to prevent unlawful access, processing and loss or damage to personal information. We have implemented reasonable measures to identify all reasonably foreseeable internal and external risks to establish and maintain appropriate data security.
Job Seeker/Candidate information submitted to you is done so on the strict understanding that you will comply with your POPI obligations regarding safety and security thereof and that you will not further process the information without the consent of the Job Seeker/Candidate which must be obtained through us.
Freelancers :
Vital Element will ensure ongoing compliance with the obligations imposed on us by the POPI Act.
Upon submission of your details to the Gigelement platform, you consent to having your information and contact details displayed on the webpage for the purposes of potential clients contacting you for contract work. We at Vital Element only aim to serve as an information listings platform and will not accept any liability for any misuse, damages, losses, or expenses that may be incurred resulting from information being made available for the Gigelement platform.
Once you have submitted your information to us for the above-mentioned purposes, the onus will fall on you to ensure that any changes in your personal information or request for removal thereof is communicated to us and any such changes will be attended to within 48 hours.
Please note:

Vital Element does not receive any form of remuneration for providing GIG employee information to clients and we do not charge any fee for displaying Gig employee’s information.

Vital Element will not be responsible for any rate negotiations, payments due or remuneration disputes that might occur.

Vital Element reserves the right to remove any GIG portfolio that does not meet our requirements.
